Abstract
Under the general heading of 'Art and the Law—Past, Present and Future', this collection of contributions, presented at the 10th Heidelberg 'Kunstrechtstag' (Conference on Art Law), deals with fundamental issues relating to the art trade, the protection of cultural property, art law and art procedural law. It also focuses in particular on the new Act on the Protection of Cultural Property, which is regarded as the current key issue in art and cultural law: the attribution of works of art, copyright law as an instrument of post-production, thoughts on the reform of the 'Limbach-Kommission', national art today – reflections on the new Act on the Protection of Cultural Property 2016 – with a special focus on the protection of German cultural property, the legal dispute between the cultural foundation 'Kunstsammlungen zu Weimar' and Edward I. Elicofon 50 years after the discovery of two portraits by Dürer in New York, the non-disclosure of a vendor’s limit by the auctioneer and the use of that limit as a covert bid.
