Abstract
The “German Hooligan File” managed at the German Federal Criminal Police Office (BKA) is designed primarily to prevent violent conflicts in connection with football matches. The personal data contained in this file is stored as a result of offences and incidents in the areas of repressive criminal prosecution and preventive security measures.
This study examines whether the use of personal data in the database complies with the requirements of the BKA Code and the basic principles of data protection law and constitutional law in Germany. It describes aspects including preventive prohibition with the reservation of authorization; the principle of necessity from the perspective of data protection law; and the principles of transparency and legal certainty on the basis of the BKA Code, the BKA Data Regulation and the BKA Formation Directive. This is followed by a presentation of potential solutions.
